Judge grants diversion for ex-Belvedere resident charged in son’s boating death

A former Belvedere resident charged in a 2019 boating accident that killed his young son will have his case dismissed if he completes a court-ordered rehabilitation program, a Marin judge ruled last week.

Javier Burillo was granted misdemeanor court diversion Nov. 9 in Marin County Superior Court. The decision from Judge Geoffrey M. Howard means the misdemeanor charges against Burillo, 60, will be dropped if he meets certain rehabilitative conditions within a prescribed period. He will have no criminal record, and the court files can be sealed and destroyed.
