Tiburon has until Oct. 24 to decide whether a Berkeley developer’s fourth application to build nine townhomes on the Point Tiburon Plaza parking lot is complete.

Black Oak Ventures filed the latest version of its 1801 Tiburon Blvd. application the evening of Sept. 24, starting the town’s 30-day review.

If the application is complete, the town will have until Nov. 23, 60 days from when it was submitted, to approve or deny the project, town senior planner Kristin Teiche said.

The town can also impose conditions of approval, Teiche said.

The project is proposed under Senate Bill 684, the 2023 Starter Home Revitalization Act. The law requires ministerial approval of qualifying small housing projects that meet objective standards, without public hearings or discretionary review. It applies to developments of 10 homes or fewer.
