Resident group says Belvedere issued Mallard Pointe permits prematurely

Belvedere Residents for Intelligent Growth has appealed the city’s Mallard Pointe bulkhead permits, arguing they were issued before required geotechnical and flood-plain reviews were done. The city has said it can’t halt work while the appeal waits for a City Council hearing.

The group, formed in 2021 to fight the 40-home redevelopment, filed the appeal Oct. 6, five days after the city issued the two permits for tearing out and replacing the shoreline bulkhead along the Belvedere Lagoon edge of the 1-22 Mallard Road site. It asks the council to rescind or suspend the permits and stop bulkhead work until the steps it says are missing are done.

The council will hear the appeal Nov. 9, or earlier if possible, the city said in an Oct. 12 update to residents.

In an Oct. 9 letter to the group’s attorney, City Manager Robert Zadnik said the city could not grant the request to stop work in the meantime. Under the state building code the city has adopted, the building official may suspend a permit only if it was “issued in error or on the basis of incorrect, inaccurate or incomplete information, or in violation of any ordinance or regulation,” Zadnik said, citing the code, and an appeal alone is not grounds.

“The building official does not believe that any of these circumstances apply in the instant case,” he said.
